Employment, Personal Injury, Accident & Injury

Boston personal injury lawyer, Joel H. Schwartz, P.C. is one of the most widely known and respected names in personal injury law today. There are a number of reasons for this. Foremost among them is the firm's long and enviable record of performance.  The firm has been helping accident victims for over 49 years and has recovered hundreds of millions of dollars in compensation for its clients over that time. Today, Joel H. Schwartz, P.C. is comprised of more than thirty focused professionals who are committed to providing clients and referring attorneys alike with a level of service that invites comparison and is now one of the largest personal injury firms in all of New England. With our knowledge and unwavering commitment to our clients, our firm produces consistent and impressive results.  With an enviable record of precedent-setting wins, our firm is recognized not just for leadership, but for visionary groundbreaking as well. From years of firsthand experience while maintaining a steadfast commitment to ensure the rights of accident victims, we've learned how to anticipate and respond to change. We've also become known for envisioning what could be and having the resolve and resources to achieve it.  We handle auto accidents, slip and falls, workers compensation, wrongful death, dog bites, nursing home abuse, medical malpractice, defective products, social security disability claims (SSI and SSDI), construction site accidents, sexual harassment in the workplace, brain damage cases, and all other personal injuries.

With personal injury claims, experience makes all the difference.  We deal with these insurance companies on a daily basis, and the relationships we have established with them truly makes a difference in the offers made.  All lawyers are NOT the same.  We have successfully handled over 30,000 claims in our history – everything from small little fender bender cases to multi-million dollar brain injury cases, and everything in between.  Our website has dozens of testimonials of satisfied clients as well as attorneys who have referred personal injury matters to us.  We conduct seminars regularly to other attorneys in the field of personal injury law for the Massachusetts Bar Association, various law schools, and other continuing education courses.  Our record truly does speak for itself.

Just as important as the monetary outcome, however, is the process.  From start to finish, the philosophy is to treat each client as if they are the only one in the office.  You will be regularly updated on your case so you always know what is going on, and we are always available to answer any questions that you have.  Our goal is to have you focus on your recovery while we do everything else for you – all the paperwork, phone calls, investigation, making sure your medical bills and any lost wages are paid, etc.  We pride ourselves with the client service we provide.

We would love the opportunity to show you what our firm can do and why we stand out from the other law firms that claim to be experts in this field.  We refer you to our website – www.joelhschwartz.com – to review our past successes, read dozens of testimonials from happy clients and referring attorneys, and see our firm regularly written up in Lawyers Weekly Newspaper.

Please contact us if you need an experienced Boston personal injury lawyer who understands the issues accident victims face.  As always, the consultation is free.  Call now 800-660-2270

  • Our attorneys write articles frequently for various publications including articles for the Massachusetts Bar Association.

We also provide a free e-newsletter every month that contains helpful tips to keep your family safe.  If you wish to receive this important publication, please feel free to sign up on our website at www.joelhschwartz.com/contact.php.  Again, it's free!
The consultation is always free. Our office works on a contingency fee basis which means we ONLY get paid if we obtain a settlement that is acceptable to you (you are the boss!). Our fee is a percentage of the gross amount received, and we take our fees only from the insurance proceeds that come at the end of your case. In other words, you never have to reach into your pocket and pay us anything - we take all the risk.

Representing Social Security Disability clients for many years, we are all too familiar with the scams our clients have dealt with. Here are some tips to avoid being a victim:
The Ups and Downs of the Program for Voluntarily Reclassifying Your Workers
whether a worker is properly classified as an employee or as an independent contractor depends upon the facts and circumstances. Generally, the determination is made under common law tests considering the right to control and direct the individual performing services. However, in some factual situations, the determination of the proper worker classification status may not be clear.
The IRS Says I Owe More Tax and We Couldn’t Reach an Agreement. Now What?
when a taxpayer receives a notice from the IRS proposing an additional assessment of tax, the taxpayer can often work administratively with the IRS to resolve the dispute. However, many times, the taxpayer and IRS are not able to come to an agreement. In those instances, there are four different forums which can be utilized to litigate a Federal civil tax case: the United States Tax Court, United States District Courts, the United States Court of Federal Claims, and United States Bankruptcy Courts.
QBI Guidance Issued; Safe Harbor Provided for Real Estate Enterprises
as we detailed in Section 199A: New 20% Pass-Through Deduction1, the Tax Cuts and Jobs Act of 2017 created new Internal Revenue Code §199A-providing a significant tax break to flow-through entities and structures. Subject to certain limitations, many eligible taxpayers (excluding C corporations) may deduct up to 20% of the “qualified business income” (QBI). Significantly, even qualified real estate businesses may benefit from the deduction.2
IRS Reminds You to Report Virtual Currency Transactions
on March 23, 2018, the IRS issued IR-2018-71, reminding taxpayers that they must report income from virtual currency transactions on their income tax returns. The IRS defined virtual currency as “a digital representation of value that functions in the same manner as a country’s traditional currency.” The IRS emphasized that, as with any other property transactions, virtual currency transactions are taxable.
No Evidentiary Burden for IRS Applicable to Accrued Interest and Penalties
taxpayers who are delinquent with their IRS taxes all too often find themselves facing rapidly accruing interest and penalties, which snowball into dismally high amounts. As the case discussed below indicates, when delinquent taxpayers and the IRS have repeatedly failed to resolve a matter, the IRS can file an action to reduce liabilities to judgment. And, assuming the action is filed within the statute of limitations (SOL) applicable to all tax years at issue, the IRS can easily win on motion for summary judgment to collect the accrued interest and penalties without submitting any evidence in its motion regarding these amounts. Cases like this should be read to prompt delinquent taxpayers to engage the services of a tax professional who can help them find a resolution with the IRS as soon as possible.
