Angela is a British and Canadian lawyer who, over the last 25 years, has built a reputation as a strong litigator in some of the most complex and challenging areas of litigation. She is best known for her defense and prosecution of claims of medical malpractice and other claims of professional indemnity. Since arriving in Kelowna her focus has shifted to include wills and estate litigation.

Angela’s estate litigation practice includes advising those who have been disappointed by their inheritance, receiving a smaller share than they consider fair or being disinherited. She also assists those who seek to challenge the validity of a will, personal representatives considering litigation or facing possible litigation from beneficiaries and other claims arising under the Wills Variation Act and the Wills, Estates and Succession Act. She regularly attends the Canadian Bar Association Wills, Estate and Trust Section meetings and enjoys being a guest at the Kelowna Estate Planning Society’s events. In line with Angela’s life long passion for learning, she has embarked on the Society for Trusts and Estate Practitioners examinations.

Angela’s medical malpractice practice includes settling claims for injured patients in excess of $6.5m. Compensation has been secured for a wide range of injuries including missed fungal meningitis, ruptured brain aneurysm, spinal abscess, and brain abscess; implantation of faulty surgical devices, cerebral palsy and other birth injuries, orthopedic surgery, vascular surgery, chiropractic manipulations and delayed diagnosis of cancer and other treatable conditions.

Angela was born in England and attended business school, obtaining a Bachelor’s degree in Science and Economics, before attending law school in Cardiff, Wales (1994). She immigrated to Canada with her family in 2006 and relicensed in BC and subsequently Alberta and Ontario. Angela is a certified and experienced mediator having trained in the UK (CEDR) the USA (Pepperdine University, CA) and Canada (Justice Institute of BC; Community Mediation, Ottawa). She is a Certified Mediator and on the Civil Roster of Mediate BC. She is a sought after speaker across Canada in her fields of medical malpractice, health care law, risk management, professional indemnity, and mediation. Angela was faculty with CME Cruises providing education to physicians and has presented during grand rounds to the medical community on medical-legal topics.

With a keen interest in local community volunteering, Angela has provided hundreds of hours of volunteer work as a trained crisis line responder and provided victim support through the community rape crisis center. She is certified in mental health first aid (ASIST) and is an avid supporter of raising awareness for mental health issues.

Angela was appointed to the Board of Directors of the Canadian Mental Health Association, Kelowna in June 2019 and a Director of the Brain Trust in August 2019. She also provides her services to the Advisory to the Judicial Council Committee, vetting candidates who apply to the Provincial Bench.

Angela is married with two grown-up daughters. She enjoys skiing, learning to play golf and preparing dinner with her family. She joined Pushor Mitchell LLP as Associate Counsel in 2019. Please describe a case in the last year or two where you made a big difference.
A recent claim against a chiropractor for damages for clinical malpractice causing personal injury resulted in a $3m settlement for a young many who suffered a stroke several days after a neck adjustment by his chiropractor. I demonstrated that the neck adjustments were contra-indicated due to a preexisting condition about which the chiropractor knew nothing - because he had failed to undertake a complete history. Claims against chiropractors are especially tricky because of the lack of solid scientific evidence. Much of the evidence relied upon by the defence, while sounding reasonable, is junk science. The challenge is finding the right angle to expose this fact.

A recent wills variation case involved a disabled son disinherited by his father in favour of an able bodied son to whom was felt the majority of the estate, the primary asset being an engineering business. The disabled son had been born with cerebral palsy and could not be expected to live independently. I carefully gathered evidence from appropriate experts to demonstrate the manner and extent of the likely deterioration and the growing dependency of the disabled son on a care giver and the associated costs. The claim required expert evidence from accountants, a business analysts and medical experts before a settlement obtained securing the disabled son's future care.

How did you build a successful practice?
I have built a successful practice by treating clients as I would like to be treated- by being accessible, empathetic, giving common sense advice based on 25 years of experience. I have always been candid and transparent with the advice I give to ensure client have all the facts to give me informed instructions. I am also well known in the legal community and receive referrals from other professionals including lawyers, social workers, counsellors, OTs, estate planners, accountants etc.

What differentiates you from other lawyers in your community?
My clients typically comment positively on my compassion and empathy and thank me profusely for all the hard work which has gone into successfully concluding their claim. Many clients stay in touch over the years to share with me how their lives has been improved following the settlement.

Are you involved in your community?
Community involvement has always been important to me. In the legal community I have served on the Board of the Trial Lawyers' Association, I have been credited to provide Continuing Legal Education programs, volunteered with the Lawyers Assistance Program, provided Continuing Medical Education to physicians and continuing education to nurses and nurse practitioners across the breadth of Canada.

Outside of the legal community I have extensive training and volunteering hours with a local rape crisis centre, 24 hours suicide/distress line, I sit on the Board of Canadian Mental Health Association and Brain Trust Canada and volunteer as a certified facilitator in the local restorative justice group.
