Despite her terminal cancer, brain tumor, heart condition and seven operations his mother repeatedly was denied Social Security Disability benefits – only being allowed benefits after a former North Carolina governor interceded on her behalf. Brian knows that underneath every injustice put out by the large bureaucracy is a human being just trying to survive with dignity and respect. Vulnerable individuals should not face this challenge without committed advocates by their side, lawyers who put forward the strongest possible case at every step of the process, optimizing the claimants’ chances for a favorable outcome at the earliest possible opportunity. Represented numerous claimants at Social Security administrative hearings and assisted other attorneys in the preparation for hundred of other hearings. In addition, he has drafted many Social Security Appeals Council briefs and United States District Court opening and reply briefs. More than 15 years of business, customer service and human resources management experience. Many skills from his education and business experience, including the abilities to handle multiple tasks within short deadlines, perform extensive efficient research, analyze information and data to produce workable solutions, and work diligently inside a team framework towards common goals. As an attorney, worked in a high-volume law practice – interviewing hundreds of potential new clients, meeting with multitudes of current clients, preparing cases for numerous hearings, managing the activities and work product of multiple staff persons and representing scores of clients at hearings and on appeals. Please describe a case(s) in the last year or two where you made a big difference.
Assisted a 45 year old individual apply for, appeal denials on, and ultimately win Disabled Adult Child (DAC) Benefits. The interesting and challenging aspects about this case include: the requirement that one prove she was disabled prior to age 22, so in this case we had to prove disability as of 23 years before the present day. In addition, Social Security incorrectly insisted that they had decided this individual's DAC benefits claim previously, thus deciding the case again was barred by the legal concept of 'res judicata' (the thing already has been adjudged.) This case was so clearcut that despite their insistence, it was obvious to us that Social Security actually had never considered or decided the DAC claim. The judge agreed with us and the client was awarded everything she had asked for - significant back pay and much higher monthly amount of benefits.

How did you build a successful practice?
Small firm law practice specializing in Social Security Disability and SSI disability benefit claims, Veterans' Compensation and Pension benefits, and related administrative law matters. Aviva G. What should clients look for in a lawyer?
You do not need an attorney or representative to win your case BUT having an attorney does increase your odds of being awarded. An attorney has the proper knowledge and expertise to assist you with your case. An attorney also has a vast number of resources to deal with the specific issues and medical conditions that you are claiming in your case as well as access to federal social security laws, prior social security rulings and medical research tools that will increase your odds of winning at a hearing. An attorney can help you at any level of your case. This includes filing the initial application, filing a request for reconsideration, filing a request for hearing and then ultimately representing you at a hearing if necessary.

What information do you need in a free phone consultation?
The individual's age, the number of years worked in the prior ten years, what kind of work the individual has done for the prior 15 years, whether the individual has applied for Social Security benefits and if so has the claim been denied, if the caller has a representative already, the limitations the individual experiences, whether the caller has ongoing medical care.
